Courts in Israel

In Israel, there are various courts: typically, every court has different specialties, distinguishing traits, and levels of authority. Where the lawsuit will be adjudicated is determined by the value of the claim and the specialized knowledge required by the court.

  1. Small Claims Court: As of the beginning of January 2023, the Small Claims Court is able to hear financial cases involving up to 36,400₪.
  2. Magistrate’s Courts handle both civil and criminal matters, including execution orders, evictions, claims up to 2,500,000₪, civil and criminal matters, and appeals of municipal court rulings.
  3. District Courts also adjudicate both civil and criminal matters, including intellectual property disputes, claims exceeding $2,500,000₪, and appeals of magistrate’s courts’ rulings and comparable courts.
  4. Local Courts handle cases involving local government, fines, building permits, and other related issues.
  5. Administrative Affairs Court- is the court that deals with issues relating to governmental administration issues by the public .
  6. The Supreme Court and High Court of Justice (HCJ) are both federal courts. Located in the Kiryat Ben-Gurion governmental complex in Jerusalem on Sha’arei Mishpat St., the Supreme Court of Israel has the authority to decide cases that fall outside the purview of other courts, such as those involving the state’s constitution. It also serves as an appellate court for the district court.
  7. The Regional Labor Court is a specialized court that deals with labor-related issues like workplace harassment, wage claims, and employee rights.
  8. Family Courts adjudicate all disputes involving individuals who are first-degree relatives by blood or marriage, including those involving marriage, divorce, and child custody.

Once the type of court has been determined, the location where a lawsuit is tried is usually determined by where the defendant resides. Israel is divided into six districts, each with a district court and a number of lower courts under its jurisdiction -such as magistrate’s courts, family courts, administrative courts, labor courts, and local courts. If the appellant wants to file an appeal to a court decision, he must appeal to the next highest court within his district.
