What is an information warrant?

The debt enforcement authority in Israel, more so than in other countries, has the authority to implement various actions to ensure that execution winners are repaid the debts that are owed to them. One such tool is an information warrant, which authorizes the enforcement registrar to collect information about a debtor’s financials, even if the debtor has not signed a confidentiality waiver. 

What actions are authorized by an information warrant? 

The information warrant authorizes the enforcement registrar to conduct in-depth investigations on the debtor’s capacity to repay the debt. A capacity investigation is not limited to cases of debt enforcement, and can be authorized in bankruptcy cases as well. You can read more about this in the article “Capacity Investigation”.

What kind of information is collected? 

If the enforcement registrar believes that a debtor is not being entirely forthcoming about their financial assets or income, it can obtain information from various institutions including the National Insurance (Bituach Leumi) and the Population Registry (Mirsham Haochlusin).

  • National Insurance: to get information about the debtor’s employment status, source of income, amount of income, bank account and debtor’s employees
  • Population Registry: to get information about the debtor’s arrivals and departures from Israel
